Terms of service

I. General terms and conditions

§ 1 Basic provisions

(1) The following terms and conditions apply to contracts you conclude with us as the provider (DASMO GmbH) through the website https://www.feinwaelder.de/ . Unless otherwise agreed, we object to the incorporation of any terms of your own that you may use.

(2) A consumer within the meaning of the following provisions is any natural person who enters into a legal transaction for purposes predominantly outside their trade or independent professional activity. A trader is any natural or legal person, or partnership with legal capacity, acting in the exercise of their independent professional or commercial activity when entering into a legal transaction.

§ 2 Formation of the contract

(1) The subject matter of the contract is the sale of goods.

(2) By listing a product on our website, we make you a binding offer to conclude a contract through the online shopping cart system on the terms stated in the product description.

(3) The contract is concluded through the online shopping cart system as follows:
The goods you intend to purchase are placed in the “Shopping cart”. You can open the “Shopping cart” using the corresponding button in the navigation bar and make changes there at any time.

After opening the “Checkout” page and entering your personal details and the payment and shipping terms, the order details are displayed in a final order summary. If you use an instant payment system (e.g. PayPal / PayPal Express, Amazon-Payments, Sofortüberweisung), you will either be directed to the order summary page in our online shop or redirected to the website of the instant payment provider.

If redirected to the relevant instant payment system, you make the appropriate selection or enter your details there. Finally, the order details are displayed as an order summary on the payment provider’s website or after you are redirected back to our online shop.

Before submitting the order, you can check the details in the order summary again, change them (including using your browser’s “Back” function) or cancel the order.
By submitting the order using the relevant button (“Buy” or a similar label), you legally accept the offer, thereby concluding the contract.

(4) Order processing and transmission of all information required in connection with the conclusion of the contract take place by email, partly automatically. You must therefore ensure that the email address you provide is correct, that emails can be received technically, and in particular that they are not blocked by spam filters.

§ 3 Right of retention, retention of title

(1) You may exercise a right of retention only in relation to claims arising from the same contractual relationship.

(2) The goods remain our property until the purchase price has been paid in full.

§ 4 Warranty

(1) Statutory rights in respect of defects apply.

(2) As a consumer, you are asked to check the goods immediately upon delivery for completeness, obvious defects and transport damage, and notify us and the carrier of any complaints as soon as possible. Failure to do so does not affect your statutory warranty rights.

§ 5 Applicable law

(1) German law applies. For consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of the country of their habitual residence (principle of the more favourable rule).

(2) The provisions of the UN Convention on Contracts for the International Sale of Goods are expressly excluded.
